Nature of Website: You acknowledge and warrant that this Website is merely a site where third parties may post rental properties, and as such, Travel Rental Network shall in no way be construed as a broker or an agent.  Additionally, you acknowledge and warrant that you understand that Travel Rental Network does not own any of the rental properties posted on this Website, nor does it have the authority to enter into any contracts relating to same, nor shall it be a party to such contracts.  Travel Rental Network is not involved in any transactions which may take place between persons who post properties on this Website (an “Owner”) and persons who rent such properties. Therefore, the quality, safety, legality, accuracy and state of the properties or the postings are solely the responsibility of the Owners, and Travel Rental Network does not take any steps, nor does it assume any duty or obligation, to investigate or verify same.

3. Use of this Website: You acknowledge and warrant that any information you may post, transmit or submit to this Website does not and shall not: (i) infringe on your own rights; (ii) infringe on any third party’s rights, specifically but not limited to any intellectual property rights, or any other confidential or proprietary rights; (iii) constitute a criminal offence or give rise to civil liability; and/or (iv) contain any information of a defamatory, obscene or similar nature, nor any material that may contain viruses, bugs or harmful components.

THE TRN GROUP SHALL NOT BE LIABLE FOR LOST PROFITS, BUSINESS INTERUPTION, ANY COMPUTER RELATED DAMAGE OR LOSS OF DATA.  THE TRN GROUP HEREBY EXCLUDES ALL LIABILITY WITH RESPECT TO THE TRANSMISSION OF VIRUSES OR BUGS.  This EnTIRE limitation shall apply even if THE TRN GROUP wAS informed of the possible occurrence of the abovementioned damages. IN ALL EVENTS, THE TRN GROUP’S MAXIMUM LIABILITY TO YOU SHALL IN NO EVENT EXCEED $500. This limitation is an essential element of the agreement between Travel Rental Network and you. 

9. Indemnification: You agree to indemnify, defend and hold harmless (including reasonable legal fees) the TRN Group from any action relating to: (i) your use of this Website, including a dispute between you and any other users of this Website; (ii) your breach of any of the provisions of this Agreement; and (iii) any content which you post on this Website.

10. Release:  You hereby grant to the TRN Group a full and final release and forever acquit and discharge the TRN Group of and from all claims, actions, causes of action, suits, proceedings and demands of whatsoever nature, character or kind which you can, shall or may have against the TRN Group, which relate to: (i) your use of this Website, including a dispute between you and any other users  of this Website; and (ii) any content which you post on this Website.

11. Miscellaneous:  This Website,  any use of this Website and any dispute relating thereto to or to the products purchased therein shall be governed and construed by the laws applicable to the Province of Quebec (and the laws of Canada applicable therein), without regard to conflict of law rules.  Both Travel Rental Network and you agree to the exclusive jurisdiction of the court of the District of Montreal, Province of Quebec.

    This Agreement and the Privacy Policy shall constitute the entire agreement between the parties and there are no other written or verbal agreements or representations relating to the subject matters described herein.

    Should any provision of this Agreement be deemed invalid or unenforceable, those provisions shall be severed from the Agreement, but shall not affect the validity of the other provisions.

    The parties hereto acknowledge that they have requested and are satisfied that this Agreement be drawn up in English; Les parties aux présentes reconnaissent qu'elles ont exigé que ce contrat soit rédigé en anglais et s'en déclarent satisfaites.
